This Privacy Policy explains how GiftBetter, Inc., a Delaware corporation (“GiftBetter,” “we,” “us,” or “our”), collects, uses, shares, and protects information about you when you access or use the GiftBetter.com website and any other website we operate (each, a “Site”), our mobile applications, and the products, features, and services we make available through them, including features offered through third-party integrations (all of the foregoing being collectively, the “Services”).
By accessing or using the Sites or Services, you agree to this Privacy Policy and to our Terms of Use (available at https://GiftBetter.com/terms-of-use). If you do not agree, please do not use the Sites or Services. If you use the Services without a GiftBetter account, the parts of this Policy that are specific to accounts do not apply to you, but all other parts do.

- What we collect. GiftBetter collects information you provide directly, information others provide about you, and information collected automatically when you use the Services, including device, log, and usage information and cookies.
- How information is used. GiftBetter uses information to deliver and personalize gifts and rewards, operate and improve the Services, prevent fraud and abuse, communicate with users, and comply with legal obligations.
- How information is shared. GiftBetter shares information with recipients, merchants and gift card issuers, service providers, and, where applicable, the organization that sponsors or administers your access to the Services.
- No sale of Personal Information. GiftBetter does not sell Personal Information and does not share it for cross-context behavioral advertising.
- Your choices and rights. Depending on where you live and how you use the Services, you may have choices about marketing communications, cookies, and requests to access, correct, or delete your Personal Information.
- Organizations. If you use the Services through your employer or another organization, your privacy rights may be limited by your employer’s or the organization’s policies. Please also read the sections of this Policy titled “If you use the Services through an Organization.”
Who this Policy covers.
GiftBetter is a local gift card marketplace. This Policy applies to everyone who interacts with us, including people who purchase gifts (“purchasers”), people who receive gifts (“recipients”), merchants and nonprofits who list on the platform, business and partner accounts, and visitors to the Sites. Where a particular practice applies only to one group, we say so. GiftBetter gifts, cards and credits are “closed loop” or “merchant branded.” That means that they are redeemable exclusively at a particular business or affiliated group of businesses (or a particular nonprofit, in the case of donation gifts). Except in the case of physical cards, GiftBetter gifts, cards and credits are issued as URL codes, credits or tokens associated with a designated monetary value. GiftBetter gifts, cards and credits purchased by you on a single day for any one recipient may not exceed $2,000. Except where the context requires otherwise, references in this Privacy Policy to “gifts” or to “cards” or “gift cards” include gifts, cards and credits.
If you use the Services through an organization, such as your employer, a business, a partner, or a reseller (an “Organization”), that Organization may access, use, and control certain information about you and how it is used. In such circumstances, GiftBetter acts strictly at the direction of the Organization and the Organization’s privacy notices, workplace notices, and internal policies apply.
1. Information We Collect
We collect information in three ways: information you provide to us, information others provide about you, and information we collect automatically when you use the Services.
Information you provide
- Account information — such as your name, email address, and (in some cases) mobile phone number when you create an account or sign in. This may also include information provided by your employer or the person sending you a gift, if applicable.
- Gift and recipient information — such as the recipient’s name and email address or phone number, the gift amount, any delivery schedule, and any rules you set. If you upload recipients in bulk, this also includes the information in your file.
- Gift personalization content — such as any message, photo, GIF, or video you add to a gift (your “Content”), and the card design or theme you choose.
- Merchant and nonprofit information — if you list as a merchant or nonprofit, your business details and the information needed to connect your point-of-sale or gift card account or to receive payments.
- Communications — including information you provide when you contact customer support or otherwise communicate with us.
Payment information. When you pay, your card details are entered directly with our payment processor and are tokenized in your browser or app. GiftBetter does not receive or store your full card number, and we do not store merchant bank account numbers, which are handled by our payment and banking partners. We receive limited transaction details such as a payment confirmation, the transaction amount, the card brand, and the last four digits of a payment card, as applicable.
Information collected automatically
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. It does not include information that has been aggregated, de-identified, or anonymized so that it can no longer reasonably be linked to you.
When you use the Services, GiftBetter may automatically collect:
- Log data, such as browser type and settings, the date and time of a request, and referring pages.
- Device information, such as device type, operating system, device settings, unique device identifiers, and crash data.
- Usage data, such as how you interact with the Services, including pages and features used and actions taken.
- Cookies and similar technologies, as described in Section 8 below.
Cookies, analytics, and similar technologies
GiftBetter and its service providers use cookies and similar technologies to operate the Services, remember preferences, understand how users interact with the Services, protect the Services, and, where permitted, help measure and improve marketing and communications. For more information and your choices, see Section 8 below.
Information others provide about you
If someone sends you a gift, the purchaser provides your name and contact details so we can deliver it. If you use a business, partner, or reseller account, the account administrator or your employer, if applicable, may provide your information so you can access the Services. The person or Organization providing information about you is solely responsible for having the right to share it. If you access or participate in the Services with or through an Organization, including an employer, business, partner, reseller, or other enterprise customer, that Organization may provide us with Personal Information and other data about you, including identifiers, contact information, employment-related information, and information relating to your eligibility to receive gifts, credits, rewards, communications, or access to the Services. GiftBetter acts solely at the direction of the Organization with respect to such information. The Organization is solely responsible for the accuracy, sufficiency, and lawfulness of the information it provides to GiftBetter and for its decision to provide that information to us.
Location information
We do not currently collect precise geolocation from your device. We may infer a general region from a zip code you provide (for example, to show nearby merchants) or from your IP address. If we begin collecting precise location in the future in order to improve our functionality and product (such as the redemption experience), we will do so only with any consent required by law and which you, as the user, would be required to explicitly enable through your use of the Services.
2. How We Use Information
We use the information we collect to:
- Provide, operate, and maintain the Services, including processing purchases, funding and delivering gifts, and fulfilling redemptions at merchants.
- Deliver gifts and your personalization content to recipients by email, SMS, in-app notification, or supported integrations.
- Communicate with you about your account, transactions, and the Services, including confirmations, receipts, delivery notices, and customer support.
- Verify identity, prevent fraud, enforce limits, and protect the security and integrity of the Services and our users.
- Comply with legal obligations, including anti-money-laundering (“AML”), know-your-customer, tax, and unclaimed-property requirements.
- Analyze and improve the Services, develop new features, and understand how the Services are used.
- Send you marketing information about GiftBetter where permitted, which you can opt out of at any time (see Section 5).
- Notify you of changes to the Services, the Terms of Use, or this Policy.
If you use the Services through an Organization
If your participation in the Services is with or through an Organization utilizing the Services to distribute gifts, credit, rewards, surveys, messages, or other communications, GiftBetter may collect, use, process, and disclose your information as necessary to provide the Services to that Organization and as contemplated by our contract with that Organization. In those cases, GiftBetter acts solely as a service provider or processor acting at the Organization’s direction. The Organization is solely responsible for its purposes for using the Services, its instructions to GiftBetter, its internal policies, the content of any communications it elects to send through the Services, and its compliance with applicable privacy, employment, consumer protection, and other laws. GiftBetter has no responsibility or liability with respect to the Organization’s access to, use of, disclosure of, or reliance on such information, except to the extent required by applicable law.
3. How We Share Information
We do not sell your Personal Information, and we do not share it for cross-context behavioral advertising.
We share information only as described below.
Recipients and purchasers
When you send a gift, we share what is needed to deliver and present it — such as your chosen message and the sender’s name shown to the recipient. We may share delivery status (such as whether a gift was opened or redeemed) with the purchaser.
Merchants and gift card issuers
To fulfill a redemption, we share the transaction details needed to create or activate and deliver a gift card with the participating merchant and its gift card issuer or point-of-sale provider as applicable. The resulting merchant gift card is governed by the merchant’s and issuer’s own terms and privacy practices, for which GiftBetter is not responsible.
Service providers
We use trusted third parties to operate the Services, and we share information with them only as needed to perform services for us and under contracts that require them to protect it and use it only for that purpose.
These include:
- Cloud hosting and storage (all located in the United States)
- Payments and money movement
- Communications delivery — providers that send transactional email and SMS.
- Media handling — media storage and delivery providers, including GIF providers.
- Analytics, monitoring, and fraud prevention – providers that help us measure performance, detect errors, and identify fraudulent or abusive activity.
- Physical card production — a card printer and mailing vendor when you order physical cards.
Business, partner, reseller and Organizations
If you access the Services through a business, partner, or reseller account, the account’s administrators may have access to information about activity in that account, including gifts purchased and sent and associated transaction data, consistent with their own policies. If your participation in the Services is with or through an Organization (such as your employer) utilizing the Services to distribute gifts, credit, or communications to its employees, customers, or designated recipients, that organization may have access to information about activity in that account, including gifts purchased and sent and associated transaction data, consistent with their own policies. The account administrators and/or the Organization referred to above are solely responsible for their use of the foregoing information and for compliance with their own privacy practices. In such circumstances, GiftBetter acts strictly at the direction of the account administrators and/or the Organization referred to above, and GiftBetter has no responsibility or liability with regard thereto.
An Organization may access, use, export, disclose, or permit access to information associated with its account, including user-specific data, transaction data, gift activity, communications history, Content, analytics, aggregated reporting, and other information made available through the Services, in each case as contemplated by its relationship with GiftBetter and its own policies. Any such Organization, and any third party acting with its authorization or at its direction, is solely responsible for its access to and use, sharing, retention, deletion, and other processing of such information. GiftBetter is not responsible or liable for any act or omission of an Organization, or of any third party acting with an Organization’s permission or at its direction, with respect to any information accessed through or provided in connection with the Services.
Organization communications
An Organization may use the Services to send gifts, credits, announcements, surveys, reminders, employment-related materials, promotional materials, or other communications to its employees, customers, contractors, or designated recipients. Although such communications may be delivered using GiftBetter functionality, they are communications of the Organization, not of GiftBetter. The Organization is solely responsible for the content, timing, recipients, legal basis, and delivery instructions for those communications, and for any Personal Information included in or used for such communications. GiftBetter is not responsible or liable for such communications or for the Organization’s use of Personal Information in connection with them, except to the extent required by applicable law.
Legal, safety, and business transfers
We may disclose information when we reasonably believe it is necessary to comply with a law, regulation, legal process, or government request; to enforce our Terms of Use; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of GiftBetter, our users, or the public. If GiftBetter is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
Aggregated and de-identified data
We may create, compile and generate and use aggregated, coded, anonymized, or de-identified data that cannot reasonably be linked to you (“NPID”). We exclusively own all such NPID, the results of our analytical processing, and any compilations or derivative works created from it (“NPID Assets”). We reserve the right to own, use, and share these NPID Assets for any lawful business purpose, including operating, analyzing, expanding, and improving the Services and our business.
Third-party sites
The Services may link to third-party sites or services we do not control. Any information you provide to a third party is governed by that third party’s privacy policy, not this one. We encourage you to review the privacy policy of any site you visit.
Downstream Protection for Shared Content
While GiftBetter provides access controls within the Services, we do not control, and cannot restrict, what use other authorized users (including recipients or fellow employees) may make of the Content you choose to share. For example, if another user downloads your shared personalization content (such as a photo, video, or message) to their local device and thereafter distributes it directly outside the Services (via personal email, SMS, or third-party social media), GiftBetter is not responsible or liable for any such subsequent use or disclosure.
4. Data Storage and Security
GiftBetter does not own or operate physical servers. We rely on our third party hosting provider, AWS, to host and store data, including Personal Information. Data is stored on AWS servers located in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to and processed in the United States.
We take reasonable and appropriate technical and organizational measures designed to protect Personal Information, including encryption in transit and at rest, access controls, and limiting who can access data. As noted above, full payment card numbers and merchant bank account details are handled by our payment and banking partners and do not reside on GiftBetter systems.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your Personal Information, we will notify you and the appropriate authorities as required by applicable law. Notice may be provided electronically, by email, by in-app or push notification, in writing, or by other means permitted by law.
We are not responsible for any unauthorized access to , or loss of, data or the consequences thereof.
5. Your Choices
You having the following choices with regard to your information:
- Marketing communications — you can opt out of marketing emails using the unsubscribe link in any such message, or by emailing support@GiftBetter.com. You will still receive non-marketing messages, such as transaction confirmations and account or legal notices.
- SMS messages — you can opt out of text messages at any time by replying STOP. See Section 9 below.
- Cookies — you can adjust your browser settings to refuse cookies, though some features may not work as a result. See Section 8 below.
- Account information — you can review and update much of your account information in your account settings, and you can request deletion of your account as described in the Terms of Use.
6. Your Privacy Rights
Depending on where you live and whether you participate through an Organization, you may have some or all of the following rights regarding your Personal Information:
- Access — request a copy of the Personal Information we hold about you.
- Correction — request correction of inaccurate Personal Information.
- Deletion — request deletion your Personal Information, subject to legal exceptions.
- Opt-out — opt out of marketing communications, and, where applicable, of any “sale” or “sharing” of Personal Information (note: we do not sell or share Personal Information for advertising).
- Non-discrimination — you will not be discriminated against for exercising your privacy rights provided by applicable law.
To exercise a privacy right, contact us at support@GiftBetter.com. We will verify your request before acting on it and will respond within the time required by applicable law. You may use an authorized agent where the law allows. If you use the Services independently, you can exercise these rights directly with us; if you participate in the Services through an Organization, we may direct certain requests to that Organization, which may control the relevant data.
California residents
If you are a California resident, the California Consumer Privacy Act, as amended (“CCPA”), provides the rights described above. The categories of Personal Information we collect, the sources, the purposes, and the categories of recipients are described throughout this Policy and summarized in Section 11. We do not sell Personal Information and do not share it for cross-context behavioral advertising.If applicable law provides a right to appeal a privacy request decision, you may do so by contacting GiftBetter at the contact information listed in Section 12.
Users in the European Economic Area and United Kingdom
If you are located in the European Economic Area or the United Kingdom, GiftBetter’s legal basis for processing Personal Information depends on the context in which it is collected. GiftBetter generally relies on performance of a contract, consent where required, compliance with legal obligations, and legitimate interests, where those interests are not overridden by your rights and freedoms. You may have rights to access, correct, delete, restrict, or object to processing, and to data portability, and you may lodge a complaint with your local supervisory authority.
If your participation in the Services is with or through an Organization
If your participation in the Services is with or through an Organization, your rights to access, correction, deletion, and similar requests may be limited by, subject to, or administered in accordance with that Organization’s policies, permissions, records-management practices, and legal obligations. In such cases, GiftBetter may direct, defer, or refer your request to the Organization where the Organization controls the relevant data or decision-making. The Organization is solely responsible for determining whether and how to honor such requests where it is the controller or otherwise controls the relevant information, and GiftBetter has no responsibility or liability for the Organization’s handling of such requests, except to the extent required by applicable law. We encourage you to review the applicable Organization’s privacy notices, workplace notices, and related policies to understand how that Organization may collect, use, disclose, retain, and otherwise process your information in connection with the Services.
7. Data Retention
We retain Personal Information for as long as reasonably necessary to provide the Services, maintain accounts, complete transactions, comply with legal obligations, resolve disputes, enforce agreements, and protect GiftBetter’s business and users. Retention periods may vary depending on the type of information, the nature of the relationship with the user or Organization, and applicable legal, tax, accounting, unclaimed-property, and regulatory requirements.
Specific practices include:
- Gift personalization media — photos and video you upload to a gift are removed from our systems after the recipient redeems the gift. If your participation in the Services is with or through an Organization, then if the Organization elects to terminate the corporate rewards program, related historical Content and user media will be deleted or rendered permanently invisible, subject to regulatory retention mandates.
- Transaction and AML records — retained for the period required by applicable financial-services and recordkeeping laws.
- Operational logs and backups — certain system logs and email-processing records are retained for limited periods and then deleted on a rolling basis.
- Closed accounts — after you delete your account, we remove or de-identify your information within a reasonable time, except information we are permitted or required to retain (for example, to comply with law, prevent fraud, collect amounts owed, or resolve disputes).
Unused GiftBetter Credit at the time an account is closed is handled in accordance with applicable unclaimed-property laws.
8. Cookies and Tracking Technologies
We use cookies (small text files placed on your device) and similar technologies to operate the Sites, remember your preferences, keep you signed in, measure performance, and understand how the Services are used. We use both session cookies (which expire when you close your browser) and persistent cookies. We may also use third-party analytics cookies, such as Google Analytics.
You can set your browser to refuse some or all cookies or to alert you when a cookie is set, but parts of the Services may not function properly without them. Our Sites do not currently respond to browser “Do Not Track” signals.
9. SMS and Mobile Messaging
If you provide a mobile number, receive a gift by SMS, or otherwise opt in, you consent to receive text messages from us and our service providers in connection with your gifts and the Services — even if your number is on a state or federal “Do Not Call” list. These messages may be sent using different phone numbers or short codes. Message frequency varies, and message and data rates may apply. You may opt out at any time by replying STOP to any message; we will send a confirmation, and you may receive messages for a short time while we process your request. For more detail, see the SMS section of our Terms of Use.
10. Children’s Privacy
The Services are intended for users who are at least 18 years old. We do not knowingly collect Personal Information from children. If you believe a child has provided us Personal Information, please contact us at support@GiftBetter.com and we will take appropriate steps to delete it.

It supplements the more detailed descriptions elsewhere in this Policy.

12. Changes to This Policy and Contact
We may update this Privacy Policy from time to time. When we make material changes, we will post the updated Policy at https://GiftBetter.com/privacy-policy, update the “Last revised” date above, and, where appropriate, provide additional notice. Your continued use of the Services after the changes take effect means you accept the updated Policy.
